Terms of Service

1. This agreement

These Terms of Service (the "Terms") are a binding agreement between you and Abdelrahman Elkaliby, an individual sole trader based in the Arab Republic of Egypt, operating under the name Magicano ("Magicano", "we", "us"). They govern your use of the Magicano mobile application, the Magicano website at https://magicanopl.com, and every related service (together, the "Service").

By creating an account, or by using the Service in any way, you accept these Terms. If you do not accept them, do not use the Service.

These Terms also serve as the End User Licence Agreement for the Magicano application.

2. Eligibility

• You must be at least 16 years old to hold a Magicano account.
• You must be legally able to enter into a binding contract where you live.
• You may hold one account only. Additional or duplicate accounts will be removed.
• You may not use the Service if we have previously terminated your account.

3. Your account

• You must give accurate registration details and keep them up to date.
• You are responsible for keeping your password confidential and for everything that happens under your account.
• Tell us immediately at abdelrahman.elkaliby@gmail.com if you believe your account has been accessed without your permission.
• Do not sell, rent, share or transfer your account to anyone else.
• You may delete your account at any time from More › Settings › Delete Account.

4. How the game works

• Before each gameweek deadline you predict the scoreline of each fixture and pick who you think will score and assist.
• Predictions lock the moment a fixture kicks off. After kickoff a prediction can no longer be created or changed, for any reason.
• After each match we score your prediction automatically against the official result data and award points and cards under the scoring rules published in the app.
• Points and cards are virtual. They have no monetary value, are not property, cannot be bought, sold, transferred or exchanged for cash, and confer no rights beyond a position on our leaderboards.
• We may correct points, re-score a fixture, or adjust a leaderboard if a scoring error, a data error, or a correction from the official data source makes it necessary.
• We may change the scoring rules, the tie-break rules, or the structure of the game. Material changes will be announced in the app.

5. No gambling, no wagering, no stakes

Magicano is a free game of skill played for entertainment. It is not a gambling product and must not be used as one.

• There is no entry fee, no stake, no wager, no deposit and no purchase of any kind, ever.
• You cannot bet money on any prediction inside Magicano.
• Points have no cash value and can never be converted, redeemed or withdrawn as money.
• Nothing in Magicano is an odds offering, a betting exchange, or a wagering service, and we do not accept, hold or pay out stakes.
• Organising or promoting betting between users — inside league chat or anywhere else in the Service — is strictly prohibited and will get your account terminated.

6. Prizes

From time to time we award physical prizes to top-performing players — for example a shirt of the winner's favourite club for a gameweek winner, or a mobile phone for the highest total points at the end of a season.

A confirmed winner will receive their prize. There is, however, no guaranteed delivery date: prizes can be delayed or postponed by stock, customs or courier problems, and we choose the item, the supplier, the route and the timing ourselves, including providing an alternative of broadly equivalent value where the exact item cannot be sourced or shipped.

Prizes are a free promotional reward, not winnings. Entry is free and no purchase is ever required. Full eligibility, selection, delivery and disqualification terms are set out in our Prize & Contest Rules at https://magicanopl.com/contest-rules, which form part of these Terms.

7. Advertising

The Service is free and is funded by advertising. By using it you accept that ads will be displayed, including occasional full-screen ads between actions.

We are not responsible for the content of third-party ads or for anything you buy from an advertiser. Any dealing with an advertiser is between you and them.

Interfering with, hiding, automating or artificially inflating ad delivery is a breach of these Terms.

8. Licence to use Magicano

We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to install and use one copy of the Magicano app on a device you own or control, and to use the website, for your own private, non-commercial entertainment.

That is the whole of the licence. Any right not expressly granted here is reserved.

9. User content and community rules

Magicano includes private league chats. Anything you post there is your content, and you are fully responsible for it. We operate a zero-tolerance policy towards objectionable content and abusive users.

You must not post, send or share:

• anything unlawful, threatening, harassing, defamatory, or that incites violence or hatred;
• sexual content, sexually explicit material, or any content involving minors;
• content that is racist, sectarian, or that attacks a person or group on the basis of race, religion, nationality, gender, disability or sexual orientation;
• another person's private information, or content that impersonates another person;
• spam, scams, chain messages, unsolicited advertising, or links to malware;
• betting offers, gambling promotions or any invitation to wager;
• anything that infringes someone else's copyright, trademark or other rights.

Reporting: if you see content that breaks these rules, report it from inside the app, or email abdelrahman.elkaliby@gmail.com with the league name and a screenshot. We review every report and aim to act within 24 hours.

Blocking: you can leave any league at any time, which ends all contact with its members.

Enforcement: we may remove any content, and suspend or permanently terminate any account, without notice and at our sole discretion, where we believe these rules have been broken. Serious cases are reported to the competent authorities.

Licence to us: so that we can operate the chat, you grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce and display the content you post, solely for the purpose of running and moderating the Service. You keep ownership of your content. The licence ends when the content is deleted, except for copies we must keep for legal or safety reasons.

We are not obliged to pre-screen content, and we are not responsible for content posted by other users.

10. Fair play and prohibited conduct

You must not:

• create more than one account, or use another person's account;
• use bots, scripts, automation, emulators or any tool to submit predictions or interact with the Service;
• exploit a bug, a scoring error or a loophole instead of reporting it — doing so voids any points, cards and prizes obtained;
• collude with other users to manipulate a leaderboard, a league or a prize outcome;
• scrape, crawl, harvest, mine or bulk-download any part of the Service or its data;
• access, probe or test the API other than through the official apps, or attempt to bypass authentication, rate limits or the version gate;
• reverse engineer, decompile, disassemble or attempt to derive the source code of the app, except to the strict extent that applicable law forbids that restriction;
• interfere with, overload, or attempt to disrupt the Service or its infrastructure;
• remove, hide or alter any copyright, trademark or other proprietary notice.

11. Intellectual property — our rights

Magicano, and everything in it, is our property and is protected by copyright, trademark and other intellectual property laws. This includes, without limitation:

• the name "Magicano", the Magicano logo, and the Magicano brand, colours and visual identity;
• the names, artwork and design of the cards — the "Magic Card", "Super Magic Goals", "Super Magic Assists" and "Magicano Card";
• the wording, structure, presentation and graphic expression of the scoring system, the tie-break ladder and every explanatory text in the app;
• the application's source code, the website, the API, the database structure and the server software;
• all screens, layouts, icons, illustrations, animations, sounds and copy;
• all documentation, marketing material and store listings.

You may not copy, reproduce, republish, distribute, publicly display, modify, translate, adapt, or create derivative works from any part of the Service; you may not build, publish or assist anyone in building a product that reproduces the Magicano cards, the Magicano scoring presentation, the Magicano interface, or a substantially similar imitation of them; and you may not use our name, logo or brand in any way that suggests an association with, or an endorsement by, Magicano.

Nothing in these Terms transfers any of our intellectual property to you.

If you believe something in Magicano infringes your rights, send a detailed notice to abdelrahman.elkaliby@gmail.com identifying the work, the location of the material, and your contact details. We investigate every notice and remove infringing material.

12. Third-party data and no affiliation

Fixtures, live scores, player data and match statistics come from the publicly available Fantasy PL API. We present that data as we receive it and cannot guarantee it is accurate, complete or timely. Where the official source corrects data after we have scored a fixture, we may re-score it.

Magicano is an independent fan-made game. It is not affiliated with, endorsed by, sponsored by, or in any way officially connected to the PL, the Football Association PL Limited, Fantasy PL, any PL club, Apple Inc., or Google LLC. All club names, competition names and trademarks are the property of their respective owners and are used for identification purposes only.

13. Availability and changes

• We provide the Service on an ongoing but not guaranteed basis. We may change, suspend, limit or discontinue any part of it, at any time.
• We may need to interrupt the Service for maintenance, updates or emergency fixes.
• We may require you to update to a supported version of the app in order to keep using the Service.
• We are not liable to you for any change, suspension or discontinuation of the Service, or for the loss of any virtual points or cards resulting from it.

14. Suspension and termination

We may suspend or terminate your account, immediately and without notice, if you break these Terms, if we reasonably believe you are cheating or acting abusively, or if we are required to do so by law.

You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination — intellectual property, disclaimers, limitation of liability, indemnity and governing law — continue to apply afterwards.

15. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, secure, or that scores, data or points will always be accurate or timely.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply to you only to the extent permitted.

16. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of data, loss of profit, loss of opportunity, or loss of virtual points, cards or leaderboard position, arising out of or connected to your use of the Service.

Our total aggregate liability to you for all claims connected to the Service is limited to the greater of (a) the total amount you have paid us in the twelve months before the claim — which, for a free service, is zero — and (b) the equivalent of USD 100.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence.

17. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, liability, cost or expense (including reasonable legal fees) arising out of your content, your use of the Service, or your breach of these Terms or of any law or third-party right.

18. Governing law and disputes

These Terms and any dispute arising out of them are governed by the laws of the Arab Republic of Egypt, without regard to conflict-of-law rules. The competent courts of the Arab Republic of Egypt have exclusive jurisdiction.

If you are a consumer resident in the European Economic Area or the United Kingdom, this does not deprive you of the protection of the mandatory consumer laws of your country of residence, or of your right to bring proceedings there.

19. Apple and Google — app store terms

The following applies where you obtained the app from a store. It is required by those stores and takes precedence over anything inconsistent elsewhere in these Terms.

• These Terms are between you and Magicano only, not with Apple Inc. or Google LLC. Magicano — not Apple or Google — is solely responsible for the app and its content.
• The licence in section 8 is limited to use of the app on any Apple-branded product you own or control, as permitted by the Apple Media Services Terms of Use.
• Apple and Google have no obligation whatsoever to provide any maintenance or support for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app (which for Magicano is zero). To the maximum extent permitted by law, Apple has no other warranty obligation of any kind in relation to the app.
• Magicano, not Apple or Google, is responsible for addressing any claim by you or a third party relating to the app, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims under consumer protection or similar legislation.
• Magicano, not Apple or Google, is solely responsible for investigating, defending, settling and discharging any third-party claim that the app infringes that third party's intellectual property rights.
• You represent that you are not located in a country subject to a United States Government embargo or designated as a terrorist-supporting country, and that you are not on any US Government list of prohibited or restricted parties.
• Apple and its subsidiaries, and Google and its affiliates, are third-party beneficiaries of these Terms and, on your acceptance of them, have the right to enforce them against you as third-party beneficiaries.

20. General

• If any provision of these Terms is found unenforceable, the rest continues in full force.
• Our failure to enforce a provision is not a waiver of it.
• You may not assign these Terms. We may assign them to a successor of the Magicano business.
• These Terms, together with the Privacy Policy and the Prize & Contest Rules, are the entire agreement between us about the Service.

21. Changes to these Terms

We may update these Terms. The date at the top shows the current version. If a change is material we will notify you in the app or by email before it takes effect. Continuing to use the Service after that means you accept the updated Terms; if you do not accept them, delete your account.
